An integrative review of legal cases from 1990-2022 where informed consent involving anesthesia providers is listed as one of the primary elements of the negligence claim. Factors contributing to including informed consent as an element of the claim are presented. Additionally, leading theories of why anesthesia providers fail to provide informed consent are presented along with recommendations for practice to avoid claims of lack of informed consent in future malpractice claims.
